Duties of the occupier as per the factories act 1948

1. Plant and equipment provision and maintenance: Section 21 of the Factories Act of 1948 mandates that the occupier furnish and maintain adequate plant and machinery that is safe and without risk to health.

2. Provision of a safe working environment: Section 13 of the Factories Act, 1948 requires the occupier to provide a safe working environment for workers, including adequate ventilation, lighting, temperature, cleanliness and sanitation.

3. Training and supervision: According to Section 22 of the Factories Act of 1948, the occupier is responsible for making sure that employees are adequately trained and overseen so they can use the machinery and equipment safely.

4. Welfare facilities: According to Section 11 of the Factories Act of 1948, the occupier must provide sufficient welfare amenities including drinking water, restrooms, urinals, washing stations, and first aid supplies.

5. Maintenance of records: Section 41 of the Factories Act of 1948 mandates that the occupier keep track of any accidents, potentially dangerous situations, and any instances of occupational diseases.

6. compliance with Regulation : The occupier must abide by all rules established by the Factories Act of 1948, as stated in Section 6. Obtaining licences and permissions, submitting reports, and obtaining licence and permit which is required

7. Appointment of safety officers: Under Section 40-B of the Factories Act of 1948, the occupier must designate a competent safety officer to oversee the workers’ health and safety in the factory.

8. Display of notices, poster : Under Section 27 of the Factories Act of 1948, it is the occupier’s responsibility to post notices in the factory’s common areas advising employees of the dangers and hazards involved in their jobs as well as the safety measures that should be taken.
